Torrado Construction Co. claimed to owe more than $395,000 for contributions




PHILADELPHIA – A Philadelphia company is alleged to owe several hundred thousand dollars in unpaid benefit contributions.

International Union of Painters and Allied Trades District Council No. 21 Health and Welfare Fund, et al. filed a complaint on Nov. 27 in the U.S. District Court for the Eastern District of Pennsylvania against Torrado Construction Co. Inc. citing the Employee Retirement Income Security Act.


According to the complaint, the plaintiffs allege that the defendants have failed to remit benefit contributions from March 2016 to September 2017. They allege a delinquency of $395,977.85 is owed.

The plaintiffs also allege the defendant breached a settlement agreement that was entered into in August 2017 and alleges they are owed $14,250 per the agreement.

The plaintiffs seek judgment against the defendant in the amount of $395,977.85, court costs, interest at the rate of 5 percent, injunctive relief and any further relief the court grants. They are represented by Martin W. Milz and Syretta Jasmine Martin of Spear Wilderman PC in Philadelphia.
