PHILADELPHIA — A labor group is suing a Pennsylvania corporation, citing alleged breach of contract.
Sheet Metal Workers' Local 19, Sheet Metal Workers' Health &
Welfare Fund of Local No. 19, Sheet Metal Workers' Annuity Fund of Local
No. 19, Sheet Metal Workers' Work Assessment of Local No. 19 and others
filed a complaint Oct. 10 in the U.S. District Court for the Eastern
District of Pennsylvania against Klein Electric Advertising Inc., also
known as Electric Advertising Co., and Robert Klein, alleging that they
failed to remit their employees monthly contribution to the Employee
Retirement Income Security Act (ERISA) fund.
According to the complaint, the plaintiffs allege they sustained
financial losses as the result of unpaid contribution. The plaintiffs
hold the defendants responsible because they allegedly breached their
contractual agreement with the plaintiff by failing to pay their
employees' monthly contribution.
The plaintiffs seek judgment against the defendant in the amount of
$10,918.38 plus court costs, interest at the rate of 4.25 percent and
any further relief this court grants. They are represented by Syretta
Jasmine Martin of Spear Wilderman P.C. in Philadelphia.
