PHILADELPHIA -- Labor funds are suing Eastern Air Balance
Corporation and Timothy Roaten, citing alleged breach of contract.
Sheet Metal Workers' Local 19, Sheet Metal Workers'
Health & Welfare Fund of Local No. 19, Sheet Metal Workers' Pension Fund of
Local No. 19, Sheet Metal Workers' Annuity Fund of Local No. 19, Sheet Metal
Workers' Vacation Fund of Local No. 19, Sheet Metal Workers' Supplemental
Unemployment Benefit (SUB) Fund of Local No. 19, Sheet Metal Workers' Joint
Apprenticeship Fund of Philadelphia and Vicinity, Industry Fund of the Sheet
Metal Contractors Association of Philadelphia and Vicinity, Sheet Metal
Workers' International Training Institute (ITI) and Gary Masino, Trustee Sheet
Metal Workers' Local 19 Benefit Funds, filed a complaint on Dec. 23 in the U.S.
District Court for the Eastern District of Pennsylvania against the defendants,
alleging they failed to pay monthly contributions to the labor funds.
According to the complaint, the plaintiffs allege they
suffered damages from late paid and unpaid contribution. The plaintiffs holds
Eastern Air and Roaten responsible because the defendants allegedly breached
their bargaining agreement with the plaintiffs by failing to pay fringe benefit
contributions on behalf of employees.
The plaintiffs seek judgment against the defendants in
the amount of $80,330.78 plus court costs, interest at the rate of 4.25 percent
and any further relief this court grants.
They labor funds are represented by Benjamin Eisner of
Spear Wilderman P.C. in Philadelphia.
