Pennsylvania corportation sues construction company, alleging breach of contract

A Pennsylvania-based corporation is suing a construction company, alleging multiple law violations including breach of contract.

Strongstown’s BK Enterprises, Inc filed a lawsuit Sept. 16 U.S. District Court for the Eastern District of Pennsylvania against Walsh Construction Company of Chicago.

According to the complaint on Jan. 7, 2011, Walsh entered into a contract with the Pennsylvania Turnpike Commission for work on a project described as the Roadway and Bridge Reconstruction of the Pennsylvania Turnpike from milepost to milepost in Montgomery Country for a stated price of $150,912.

On a written subcontract dated at Feb. 15, 2011, the suit says, the plaintiff and defendant entered into a written agreement where the plaintiff agreed to furnish “barriers, signs, and attenuators” for the project.

The suit says Strongstown's was further prohibited by Walsh from removing the rented barriers and attenuators while Walsh’s work continued on the project. The complaint states Walsh failed to complete the project on time. 

Strongstown’s BK Enterprises seeks a declaratory judgment against Walsh Construction Company that there are no conditions precedent to Walsh's obligation to pay the plaintiff for additional rental of the applicable signs, barrier, and attenuators, plus the amount the defendant owes the plaintiff of $1,467,618.30, plus statuary interest, costs, penalties and attorney fees.
