PITTSBURGH — A nonprofit administrator of fringe benefits
is suing a company over alleged failure to pay union fees.
Carpenters Combined Funds Inc. filed a lawsuit on Feb. 15
in the U.S. District Court for the Western District of Pennsylvania against
C.F. Bordo Inc., James Bordo, Ceaser F. Bordo, and Leslie Bordo, citing a
breach of contract and violations of the Employee Retirement Income Security Act
(ERISA) and the Labor-Management Relations Act of 1947.
According to the complaint, the plaintiff is a non-profit
corporation for the purpose of administering fringe benefit funds and acts as a
collection agent for funds. The defendant allegedly entered into a labor
agreement with a Pittsburgh Carpenters’ Union and was obligated to make certain
monthly payments to benefit employees covered under the agreement.
The plaintiff claims that the defendant failed to make
timely payments of principal contributions and wage deductions to the plaintiff
from September through December 2016, allegedly resulting in a principal
deficiency of $116,485.95, interest in the amount of $17,968.76,
contractual/liquidated damages of $106,878.29, totaling $241,333.
The plaintiff seeks the defendant be required to file
remittance reports, all due benefits and payments, judgment in the sum of
$289,599.60, additional interest, and costs of the suit. It is represented by
