Union says firm has fallen short in pension plan contributions



PITTSBURGH – A Pittsburgh-based union is suing a construction company over a claim that it is not contributing to an employee pension fund, resulting in an estimated delinquency of more than $70,000.

United Steel, Paper and Forestry, Rubber, Manufacturing, Energy, Allied Industrial and Service Workers International Union, and Pennsylvania Heavy and Highway Contractors Pension Fund filed a lawsuit Feb. 2 in the U.S. District Court for the Middle District of Pennsylvania against Whistler Construction Company, alleging a violation of a collective bargaining agreement.


According to the lawsuit, the Whistler Construction Company has failed to remit reports and/or principal contributions to their employees’ pension plan, which is under union management, for the period of January 2014 through the time the suit was filed, resulting in an estimated delinquency of at least $70,342.71, including liquidated damages and interest.

United Steel, Paper and Forestry, Rubber, Manufacturing, Energy Allied Industrial and Service Workers International Union is seeking a judgment in the amount of $70,342.71, reasonable counsel fees, interest and costs of the lawsuit.
