Home Improvement Guarantee Fund
Upon our return, I plan to re-introduce legislation
(HB427) to amend Act 132 of 2008, the Home Improvement Consumer Protection Act,
to establish the Home Improvement Guaranty Fund. This bill was House Bill 598 during the
2011-12 Session.
The Guaranty Fund would be established within the State
Treasury and be administered by the Bureau of Consumer Protection in the
Attorney General’s Office. A contractor
that registers their business in compliance with Act 132 will pay a fee of $100
biennially to the fund. The money will
be used to compensate consumers for the actual loss that results from an act or
omission by a contractor in the performance of services, as well as a court
determined violation of Act 132.
