OSHA Releases Details of its future Rulemaking Plans in the 2013 Fall Regulatory Agenda:



The federal government released its semiannual regulatory agenda for fall, 2013 on November 26, 2013.  This comprehensive agenda lists the actions that individual agencies intend to pursue and the expected timelines associated with each agenda item.  It covers multiple federal agencies.  The entire list may be found here…

There are twenty eight entries for OSHA. Specifically, as it relates directly to the industry, OSHA has added three new actions to its agenda, including two for the construction industry and one for the shipyard industry.

OSHA is considering possible changes to standards governing scaffolds, ladders and other working surfaces in shipyards. OSHA is considering dividing the current subpart into three separate subparts to further define and clarify the standards. OSHA intends to issue a RFI to the public about the possible rule changes on or about August 2014.

OSHA has also added new proposed rules relating to the Cranes and Derricks in Construction Standard.  OSHA anticipates issuing a NPR for amendments to the Cranes and Derricks in Construction Standard in very early 2014.

The second Notice of Proposed Rulemaking for the Cranes and Derricks in Construction Standard pertains to Operator Certification.  There has been considerable and ongoing conflict between OSHA and interested stakeholders on this topic.
